MakeThemCode

Terms of service

Last updated: October 13, 2026

These terms govern the use of MakeThemCode (the “service”), published by Romaric Guth EI (“we”). By creating an account or using the service, you agree to them.

1. The service

MakeThemCode lets the members of a project change a web application by chatting with an AI assistant. A developer connects a GitHub repository. Each session runs the application in a cloud sandbox, and the changes land on a branch of the repository, merged directly or through a pull request depending on the settings of the project.

The service is intended for businesses and professionals, for the needs of their activity.

2. Accounts

You give accurate information when you sign up, confirm your email address and keep your password to yourself. You are responsible for what is done with your account. You must be able to enter into a contract, for yourself or for the organisation you act for.

3. Projects and members

Whoever creates a project chooses its members and what each of them may do. The members who manage a project are responsible for the people they invite and for what those people do in it.

Everything a project gives its sandboxes, the repository and the environment variables, can be read by its members through the assistant. Only use development credentials there, never production secrets.

4. Your code and content

Your repositories, your code, what you write in the chat and the changes the assistant produces for you remain yours. We claim no right to them.

You allow us to use them as far as running the service requires, and for nothing else: cloning the repository into a sandbox, running it, sending the conversation and the relevant parts of the code to the provider of the AI model, committing and pushing the changes, and opening pull requests in your name.

You confirm that you are entitled to connect each repository and to have it processed this way by us and by the members of the project.

5. Changes written by AI

The changes are written by an AI model. They can be wrong, incomplete or unsafe. You are responsible for reviewing them before they are merged or deployed, and for the settings that decide what is merged without a review. The service does not replace code review, tests or backups.

6. Acceptable use

You agree not to:

We may suspend an account or a project that breaks these rules.

7. Credits and payment

Prepaid balance. Usage is paid in advance. Each project has a balance in US dollars, topped up by card through Stripe, between $5 and $1,000 per payment. A receipt is available for each payment in the billing settings of the project.

Price of the usage. Each request to the AI model is deducted from the balance at the price shown in the app: the price of the model provider plus our margin. The usage page of the project shows the detail. That price follows the prices of the provider, which may change. A change of our own margin is announced by email at least 30 days in advance and only applies to the usage that follows.

Empty balance. Without credits left, sessions cannot be started or continued until the balance is topped up. The balance can go slightly below zero, by what the last request cost over what was left: the next payment covers it.

Automatic top-up. When you turn it on, you authorise us to charge the saved card the amount you chose each time the balance goes under the threshold you chose. You can turn it off at any time. A payment that is refused turns it off.

What credits are. Credits can only be spent on MakeThemCode, by the project they were bought for. They have no cash value and cannot be transferred or exchanged.

Refunds. A payment whose credits have not been used can be refunded on request within 14 days. After that, credits are not refunded, unless the law requires it or we close the service or your account without a breach on your part: the unused part of what you paid is then refunded.

No expiry. Credits do not expire.

Free credits. The credits we offer, to try a project or as a gesture, are spent before the ones you paid for. They are never refunded and may be withdrawn in case of abuse.

Disputed payments. When a payment is disputed with the bank, its credits are withdrawn and the project may be suspended until the dispute is settled.

Taxes. Prices are in US dollars. VAT not applicable, article 293 B of the French General Tax Code. Should VAT become applicable, it would be added to the prices.

8. Third-party services

The service relies on GitHub, on a sandbox provider, on an AI model provider and on Stripe (see our privacy policy). Your use of GitHub remains subject to its own terms. We are not responsible for the outages of these services.

9. Availability

We do our best to keep the service running, without committing to an availability level. Sandboxes are temporary: they are deleted when their session ends or is left idle, and only what was pushed to the branch of the session is kept. We may change or withdraw features, and tell you beforehand when the change is significant.

10. Suspension and termination

You can stop using the service at any time and ask us to delete your account at contact@romaricguth.com. We may suspend or close an account or a project that breaks these terms, puts the service or others at risk, or whose payments fail. Your repository is never affected: the branches and pull requests already pushed stay in it.

11. Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect damages, such as a loss of revenue, of data or of business, nor for what the changes written by the AI cause once merged or deployed. Our total liability for a project is limited to what was paid for it during the 12 months before the event. Nothing here limits a liability the law does not allow to limit.

12. Personal data

How we handle personal data is described in our privacy policy.

13. Changes to these terms

We may update these terms. A significant change is announced by email at least 30 days before it applies. Using the service after that date means you accept it.

14. Governing law

These terms are governed by French law. Any dispute that cannot be settled amicably is brought before the competent French courts.
